TERMS OF SERVICE
The Draft Rugby game ("DR") is an online fantasy sports community. This website ("Website") and DR are operated by Draft Sports Pty Ltd ("Draft Sports"). By registering and participating, users agree to be bound by these terms and conditions (“Terms”). These Terms set out how you may enter into and continue to participate in the Draft Rugby community (" Community"). If you do not accept the Terms, you may not enter the Community and you may not use this website. By entering and continuing to participate in the Community, you are confirming your acceptance of the Terms and your willingness to be bound by them including any changes that may be made from time to time.
Draft Sports of Sydney, NSW, Australia owns this website.
Draft Sports reserves the right to alter, modify or update these Terms without notification. You agree to review these Terms on a periodic basis.
2. Who May Play
Entry to DR is open to players in any country who are over the age of 18 years. DR is offered as a free game to all participants. All entrants consent to the publication of their name and agree to participate in reasonable promotional activities as requested by Draft Sports free of charge. Draft Sports reserves the right to limit the number of participants in DR at any time for any reason.
The terms 'you', 'participant' and 'user' are used, for the purposes of the Terms, to refer to any individual or entity participating in the Community. The expressions 'us', 'we' or 'our' refer to Draft Sports (the “Promoter”).
You agree that you will only use this website for the purpose for which it has been created.
To enter the Community, you need to register and provide accurate and complete registration information. It is your responsibility to update and maintain that information by advising us of changes to your details as appropriate. Registration is for a single user only. On registration, you will need to select a "team name", possibly a “league name” and password.The promoter reserves the right to refuse to accept any team names or league names which have been duplicated or are felt, in the promoters sole discretion, to be inappropriate, misleading or offensive. Unsuitable names may be deleted or amended. Team names that include website addresses may also be deleted or amended.
When you register to participate in the Community, you will be obliged to click on an icon confirming that you have read, understood and accepted these Terms. You will not be allowed to register unless you have indicated acceptance of the Terms and any other terms and conditions which may apply.
Your team name and password are personal to you and you agree at all times to maintain the confidentiality of these and not to disclose them to any third party. You agree that you are solely responsible for any use of the website by any person using your team name and password. You agree to indemnify the Promoter against any and all claims arising out of your failure to maintain the confidentiality of your team name and/or password.
On registration you agree that we can hold and store your registration details so we can invite you to participate in future seasons or tournaments. We will not use your registration details for any other purpose other than as stated in the Terms.
You agree that the Promoter, in its sole discretion, may terminate your password, account, or use of the website, for any reason.
Any entry or picks submitted using your team name and password will be deemed to have been submitted by you, and we do not have any responsibility or liability for any entry or picks submitted using your details.
In the case of abuse of systems or the law, the Promoter reserves the right to pass any information stored on its systems to the relevant ISP(s) or Australian Police to help prevent the abuse.

5. Participation in the Community
You agree not to:
- impersonate another person or use a false name or name you are not authorised to use, or create a false identity or email address or try to mislead others as to the identity or origin of any communications;
- restrict or inhibit any other user from using or enjoying the website;
- modify, access or make available data stored on a computer device which you have accessed through the Community, when either the owner of the data or computer device has taken steps to prevent you from doing this or the owner has expressed a wish that you do not do this;
- make available or upload files that contain software or other material, data or information not owned or licensed to you or collect information about others (such as names and addresses) without their prior consent;
- damage, interfere with or disrupt access to the Community or this website or do anything which may interrupt or impair its functionality including by means of submitting a virus to this website, overloading, "flooding", "spamming", "crashing" or "mailbombing";
- make any commercial or business use of the Community to resell or commercially benefit from any party of aspect of the Community;
- publish, post, distribute, disseminate or otherwise transmit defamatory, offensive, infringing, obscene, indecent or other unlawful or objectionable material or information; publish, post, distribute, disseminate or otherwise transmit content that you did not create or you do not have permission to post;
- threaten, harass, stalk, abuse, disrupt or otherwise violate the rights (including rights of privacy and publicity) of others;
- Solicit personal information, passwords or other information from other users
- make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, "Trojan horses", "worms" or any other harmful software;
- obtain or attempt to obtain unauthorised entry, through whatever means, to the Community, this website or computer systems or area of our or any of our partners' networks which are identified as restricted.
- Make personal or verbal contact with the organizers or sponsors of the game via any means other than the webmaster email address;
- Engage in any activities through or in connection with the website that are unlawful, offensive, obscene, threatening, harassing or abusive, or that violate any right of any third party.
You are and remain solely responsible for the content of any comments or other postings submitted to us via your registration details. You are also responsible for your interactions with other members of the Community. We reserve the right (but have no obligation) to monitor and moderate disputes between members of the Community.
You authorise us by posting content to the site to make such copies thereof as we deem necessary in order to facilitate the storage and serving of that content. By posting user content to any part of the website, you automatically grant, and you represent and warrant that you have the right to grant to the Promoter an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide licence (with the right to sub licence) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such user content for any purpose. If you remove your user content from the website at any time, the licence granted above will automatically expire, however you acknowledge that the Promoter may retain archived copies of your user content. Neither the Promoter nor any of its agents, partners or contractors engaged in the Community assert any ownership over your user content; rather, as between us and you, subject to the rights granted to us in these Terms, you retain full ownership of all of your user content and any intellectual property rights or other proprietary rights associated with your user content.
In order to use this website, it is your responsibility to procure access to the Internet, to pay any costs associated with that access and to acquire any hardware and/or software necessary to utilise the content on the site.
You agree to indemnify and hold the Promoter and its directors, officers, agents, affiliates and employees harmless from any claim or demand made by any third party due to or arising out of your use of this website.
Unless specific provisions of legislation are quoted, the Promoter does not make statements of the law in relation to any matter. The comments contained in this website about the law are summaries which may not be comprehensive or complete and should not be relied upon as legal advice. If you wish to know the law, you should either go to the relevant legislation or obtain advice from a qualified professional such as a solicitor.
The Promoter requires that you obtain its prior written approval before providing any link to this website.
6. Use of Participants Details
By entering the Community you give us permission to use your name and your "team name" (e.g. John Smith and team named "Mad Marx: Fourie Road") without compensation.
7. Communication Policy
We will not respond unless required to do so by law to any email or posting which contains threatening, abusive, malicious, pornographic, obscene, defamatory or otherwise illegal or inappropriate material. We reserve the right to take such action as we, in our discretion, see fit in respect to such material.
You agree that we may send you emails for the purpose of advising you of changes or additions to this website, of future competitions, or for promotional purposes. However, you have the opportunity to opt out of receiving communications from us and our partners at any time. To be removed from our mailing list, please ensure you click on the opt-out link in any of the emails that are sent to you.
8. Exclusion of Liability
Whilst we will make all reasonable efforts to ensure that the content on the website (including (without limitation) all information on it, whether provided by us or not) ("Content") is error-free, we do not warrant its accuracy, adequacy, correctness, reliability or completeness or that it is suitable for your intended use. The Content may contain inaccuracies and typographical errors. The Content may be updated at any time and may, at times, be out of date, inaccurate and/or incomplete. We do not have any responsibility for keeping the Content up to date, accurate and/or complete, nor do we have any liability for any failure to do so.
Your use of this website is at your own risk. This website, the Content and access to the Community is provided on an "as is" basis and there are no representations or warranties of any kind about the website, the Content and/or the Community. This website may not be continuously available and we make no assurances it is free from computer viruses or any other malicious or impairing computer program.
You agree that all conditions, warranties and representations in respect of this website, the Content and the Community of any kind, including (without limitation) accuracy, quality, suitability, fitness for purpose, or completeness of any Content, are excluded to the fullest extent permitted by law.Neither the Promoter, its directors and/or employees shall be liable for any loss, injury, claim or damage whatsoever suffered (including but not limited to direct, indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in this Community.
The Promoter assumes no responsibility for any technical malfunction, error, omission, interruption, deletion, delay in operation or transmission, communication line failure, virus, bug, tampering, theft or destruction or unauthorised access to the site, or any injury or damage to any person's computer related to the use of the site, or the streaming of material or downloading of any software/material (where permitted) from this website.
The Promoter is not responsible for the content of websites linked to or from this website that are not owned by the Promoter. Any links provided are for your convenience only and are not an endorsement of the other companies or products referred to on those other websites. The Promoter has no responsibility for the condition, content or operation of any such other websites and shall not be liable for any damages or injury arising out of or resulting from access to or use of such websites. If you click on a link to another website, you do so entirely at your own risk.

You are only permitted to download, display, print or reproduce the materials in unaltered form for personal use, non-commercial use, research or study, and provided you agree to refer to the Promoter as the owner of the copyright in such material. This includes all intellectual property rights in respect of all text, graphics, logos, images and any downloads that may be offered on this website. We may suspend or cancel the game or your participation in it at any time without notice. We may suspend, cancel or terminate any user accounts at any time for any reason or no reason at our sole discretion. Our exclusion of liability will survive such cancellation.
13. Governing Law
Australia: Use of this website, these Terms any Additional Terms shall be governed by and construed in accordance with the laws of Australia without reference to principles of conflict of laws. You agree to be bound by such laws and irrevocably and unconditionally agree to submit to the non-exclusive jurisdiction of the courts of Australia in connection with the interpretation or application of these Terms and any Additional Terms.
Outside Australia: Those who choose to access this website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
The Promoter may, at any time, amend or delete any of these Terms without notice by updating this website. All changes are effective from the date of posting the revised Terms on this website. Any updated version of the Terms will immediately supersede any prior version. Please ensure that you check the Terms on a regular basis to review any modifications made.
